The agreement, in plain language.

1. Acceptance

By creating an account or using mcard (“the service”, “we”, “us”), you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the service.

2. Your account

You're responsible for keeping your login credentials safe and for everything that happens under your account. You must be at least 16 years old (or 13 with parental consent where law permits) to use mcard. Don't share an account with someone else; create separate accounts instead.

If you believe your account has been compromised, email support@mcard.appand we'll help you secure it.

3. Your content

You keep ownership of everything you put on your card — your name, photos, links, sections, the leads you collect, and so on. You grant us a limited, non-exclusive license to host, display, and serve that content as needed to provide the service: rendering your public card page, generating Open Graph previews, sending lead notifications, and so on. That license ends when you delete the content or your account.

You're responsible for what you put on your card. Make sure you have the right to use any photos, logos, or text you upload — including testimonials and gallery images that depict other people.

4. Public cards

When you publish a card, anyone with the URL can view it. Don't put anything on a published card that you wouldn't want a stranger to see. If you want a card to be private, keep it unpublished — you can still preview it from your dashboard.

5. Acceptable use

You agree not to:

  • Impersonate someone else or pretend to represent a business you don't represent.
  • Upload content that's illegal, harassing, defamatory, sexually explicit involving minors, or that incites violence.
  • Use the service to spam, phish, or run scams. The lead form is for legitimate inbound contact, not for distributing unsolicited offers.
  • Reverse-engineer, scrape, or rate-abuse the service. Reasonable, attributed indexing by search-engine crawlers is fine.
  • Upload malware, exploit kits, or content that probes for security vulnerabilities in visitors' browsers.
  • Use the service in violation of applicable export controls or sanctions laws.

We may remove content or suspend accounts that violate these rules. We'll try to give you notice and a chance to fix things first when it's reasonable to do so.

6. Subscriptions, billing, refunds

mcard is currently $99 per year. Designing a card is free; the paid plan is required to publish your card to a public URL. You can subscribe at Settings → Billing.

Auto-renewal. Subscriptions renew automatically on the anniversary date until you cancel. You can cancel any time from the billing portal; cancellation takes effect at the end of your current paid period.

Refunds.If you're unhappy in the first 14 days of a new subscription, email us and we'll refund you in full. After 14 days, refunds are at our discretion and generally aren't available for the remainder of an annual term, but we'll consider exceptional circumstances.

Failed payment. If a renewal payment fails, we mark your subscription as lapsed and unpublish your card pages until the issue is resolved. Your data is retained — you just need to update your card on file to publish again.

Price changes.If we change the price, the new price applies on your next renewal — never mid-term — and we'll email you at least 30 days before the change takes effect.

7. Lead-form responsibility

If you enable the lead form, you're the data controller for the contact details visitors submit. You're responsible for handling those contacts in compliance with applicable law (TCPA, CAN-SPAM, GDPR, CCPA/CPRA, and state privacy laws). Don't text or call submitters without consent. Don't add submitters to a marketing list they didn't opt in to.

8. Termination

You can delete your account at any time from Settings → Profile. We can suspend or terminate accounts that violate these Terms or that create legal or operational risk for the service. If we terminate your account for cause and you've prepaid for a term, we won't refund the unused portion.

9. Disclaimer of warranties

mcard is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee uninterrupted availability, error-free operation, or that the service will meet every requirement you have. Some jurisdictions don't allow disclaimers of implied warranties; to the extent applicable law requires implied warranties, those apply notwithstanding this section.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50. We're not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, even if we've been advised of the possibility.

These limits don't apply to liability that can't be limited under applicable law (for example, gross negligence, willful misconduct, or fraud).

11. Indemnification

You agree to defend and indemnify mcard against third-party claims arising from the content you publish, your violation of these Terms, or your violation of someone else's rights — including reasonable attorney's fees. We'll notify you of any such claim and give you reasonable cooperation in the defense.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes arising out of or relating to the service will be resolved in the competent courts of that jurisdiction, and you consent to personal jurisdiction there.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual-property rights.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll bump the “Last updated” date and email logged-in users at least 14 days before the changes take effect. Continued use of the service after the effective date means you accept the updated Terms.

14. Miscellaneous

If any provision of these Terms is held unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of our right to enforce it later. These Terms are the entire agreement between you and us about the service.
